Why is there a lawsuit against Syngenta? Can I file a claim?

Currently, in the US, some corn farmers and other companies in the corn industry have filed a lawsuit against Syngenta. They are claiming Syngenta’s decision to market their GMO corn seed, Agrisure Viptera MIR162, before they had approval from China has had a serious and detrimental effect on corn market prices in the US.

 Syngenta’s genetically modified seeds have been very beneficial for agriculture, they’re more resistant to insects and produce a higher quality crop. However, it’s important they follow regulations. Their disregard for the rules has negatively impacted the entire corn market, corn farmers have claimed.

Not only have farmers been affected but also landlords (because farmers cannot pay rent), exporters (they have no work available), wholesale retailers and many others. Some farmers have had to close their farms and sell land because of the hit in corn market prices.

How did this start?

How could a large worldwide company like Syngenta have such an impact on the US corn industry?

In 2009, Syngenta first released their GMO corn into the US corn supply. At that time, Syngenta had import approval in US, Argentina and Brazil but was still waiting for China to approve. Even though they did not have China’s approval to import Viptera corn, Syngenta marketed their seeds to farmers, claiming the approval would arrive soon.

However in 2013, traces of Viptera corn were found in shipments sent to China and because there was still no Chinese confirmation at this time, the shipments were sent back (or in some cases destroyed). It was at the end of 2014, when Syngenta finally received approval for their GMO corn seeds in China.

The impact on the US corn industry

Current lawsuits against Syngenta have argued that Syngenta’s decision to market the Agrisure Viptera MIR162 without Chinese approval, shows they were looking after their own interests rather than those of the farmers or other businesses in the corn industry. They took a risky gamble, hoping they would get approval in time.

Corn bushels decreased from $7 to $3. A significant drop in prices.

Farmers require a worldwide demand of corn in order to benefit financially. By adding Agrisure Viptera corn seeds into the corn supply and marketing it to corn farmers, saying it was close to getting Chinese approval, was a mistake.

Who can file a claim against Syngenta?

This has affected the entire corn industry, not just corn farmers, so anyone who believes they have been negatively impacted could file a lawsuit against Syngenta.

Some corn farmers cannot afford to pay their landlords, this means landlords have lost income and they can file a claim. Transporters, who regularly transport and export corn, can file a claim if they can show the drop in corn prices has financially impacted them.

Corn farmers who did not use Viptera corn seeds can file a claim too because the drop in corn prices has affected everyone. It’s unfair that another company’s decision has had a huge toll on your farm and the entire corn market.
